Endor CLI / VM Runner and all related executable code, libraries, and associated files (collectively, the “Software”)
PLEASE READ THIS AGREEMENT CAREFULLY. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS END USER LICENSE AGREEMENT (“AGREEMENT”). IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE SOFTWARE.
1. Grant of License
Subject to the terms and conditions of this Agreement, The Endor Developers hereby grant you a limited, non-exclusive, non-transferable, revocable license to use the Software solely in connection with the Endor platform for the purposes of execution, development, and integration.
This license permits:
- Installation and use of the Software on an unlimited number of devices;
- Use for personal, educational, or commercial purposes, provided such use remains in accordance with the restrictions set forth below.
2. Restrictions
You shall not:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or inner workings of the Software;
- Modify, translate, adapt, or create derivative works based on the Software;
- Distribute, sublicense, lease, rent, sell, or otherwise transfer the Software or any portion thereof to any third party;
- Use the Software in any manner independent of or disconnected from the Endor platform or for the purpose of replicating the functionality of the Endor Service.
3. Intellectual Property
The Software is licensed, not sold. All title, ownership rights, and intellectual property rights in and to the Software, including any copies thereof, are and shall remain the exclusive property of The Endor Developers and/or its licensors.
4. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SOFTWARE WILL OPERATE WITHOUT INTERRUPTION OR ERROR.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL THE ENDOR DEVELOPERS OR THEIR AFFILIATES, CONTRIBUTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE ENDOR DEVELOPERS ARISING UNDER THIS AGREEMENT EXCEED ZERO U.S. DOLLARS (US $0.00).
6. Termination
This Agreement and the license granted hereunder shall automatically terminate without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Software and destroy all copies in your possession or control.
7. Open Source Components
Portions of the Software may include or be derived from open-source software licensed under separate terms (“Open Source Software”). Your use of such Open Source Software is subject to the applicable open-source license(s) and not this Agreement. A list of included open-source components and their corresponding licenses may be provided in a separate file or directory included with the Software distribution.
The Endor Developers make no claim of ownership over such Open Source Software and provide it “as is” with no warranties or guarantees.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state or federal courts located in the State of Delaware.
9. Related Terms
Use of the Software in conjunction with the Endor web platform is additionally governed by the Endor Terms of Service, available at: https://endor.dev/terms.
